We respect other people’s intellectual property, and expect people who use The Gift Guide to do the same. Lists show product names, photos and descriptions taken from shops so givers can recognise a gift. If something on The Gift Guide uses your work in a way you haven’t allowed, tell us and we’ll deal with it promptly.

Reporting infringement

Send a notice to our designated copyright agent. Under the US Digital Millennium Copyright Act (17 U.S.C. § 512), it must include:

  1. your physical or electronic signature;
  2. the work you believe is infringed (or a list, if there are several);
  3. the material you believe infringes it, with enough detail to find it, ideally the link to the list or item;
  4. your name, postal address, phone number and email address;
  5. a statement that you believe in good faith the use isn’t authorised by the owner, its agent, or the law;
  6. a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner, or are authorised to act for the owner.

Designated agent: [DMCA agent name and address — to be filled in]
Email: hello@wantlist.app (subject line “Copyright notice”)

Knowingly misrepresenting that material infringes can make you liable for damages. If you’re not sure, consider getting legal advice first.

What happens next

When we receive a valid notice, we remove or disable the material, and tell the person who posted it, sending them a copy of the notice.

Counter-notices

If your content was removed and you believe it was a mistake, or that you had the right to use it, you can send a counter-notice to the same address. It must include:

  1. your physical or electronic signature;
  2. what was removed, and where it appeared before;
  3. a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification;
  4. your name, address and phone number;
  5. a statement that you consent to the jurisdiction of the federal district court for your address (or, outside the US, any district where The Gift Guide may be found), and will accept service from the person who sent the original notice.

We’ll pass it on to the person who complained. Unless they tell us within 10 to 14 business days that they’ve gone to court, we may put the content back.

Repeat infringers

We close the accounts of people who repeatedly infringe others’ rights, as our Terms explain.

Trademarks

Shop and brand names on The Gift Guide identify where a product comes from. They don’t mean that shop or brand endorses us or is connected with us. Trademark concerns can go to the same address.
